TUPETUPE

What on earth does this mean?

Well imagine that you work for a Law firm Blogs LLP and you are the IT Manager. All is going well until your business decides to outsource all the IT to a local IT company “The IT Fixers” because they can run your department more cost efficiently than having an internal resource.

You have a team of 25 people you are responsible for. The “IT Fixers” decide to take you and your team of 25 people onto their books and get you to do the same job for Blogs LLP but you have a different employer.

The Transfer of Undertakings (Protection of Employment) Regulations 2006 referred TUPE 2006 is the main piece of legislation governing the transfer of an undertaking (also known as people) from one business to another.

The regulations are designed to protect the rights of employees in a transfer situation enabling them to enjoy the same terms and conditions, with continuity of employment.

This is not an easy part of employment law even for us HR people so if you would like some support please give us a call on 0845 4599710 or email us on info@pvhr.com
