Avoid tribunals at the recruitment stage…
17 June 2010
Did you know that there are people out there who try to trick you during the recruitment process so that they may make a claim for discrimination of some kind?
As an example there was the recent case of "Keane v Investigo". This female 50 year old experienced accountant had applied for jobs advertised as suitable for newly qualified accountants. She then claimed age discrimination against the recruitment agencies when she was not invited to interview even though she had no intention of taking the jobs. Thankfully the Employment Appeal Tribunal has upheld a decision to dismiss a number of claims made by her in this area.
Candidates will also submit two applications usually as the same sex but with different ethnic origins and names in the hope that you will select the one that sounds “English” thus discriminating against the other applicant.
Top tips for avoiding discrimination at the recruitment stage:
1. Prepare a detailed person specification which provides a criteria that you can shortlist candidates against.
2. Ensure that only one person shortlists all applicants for the same job to minimise risk of differing standards.
3. Train all your line managers so that they know what questions to avoid in an interview .
